1. Parties and scope
These Terms (“Agreement”) are between the entity operating under the iRhyde brand (“iRhyde Mobility”, “we”, “our”) and any person or organization that accesses our rider apps, driver apps, APIs, or administrative portals (“you”, “user”). By creating an account or using the services, you agree to be bound by this Agreement.
2. Account eligibility
- Users must be at least 18 years old (or the age of majority in their jurisdiction) and capable of entering into a binding contract.
- Drivers must complete KYC, hold valid licences, and keep documents current. We may conduct periodic background or motor vehicle record checks.
- Platform credentials are personal. Sharing tokens, bypassing security controls, or creating duplicate accounts is prohibited.
3. Platform licence
We grant you a limited, revocable, non-transferable licence to use our software strictly for requesting or providing transport and logistics services. You may not reverse engineer, scrape, bulk export data, or use automated tools except via approved APIs.
4. Pricing, payments, and taxes
- Rider fares are disclosed before confirmation. Charges may include base fare, time, distance, surcharges, tolls, and applicable taxes.
- Drivers authorize iRhyde to deduct service fees/commission and to remit earnings via approved payout partners. Drivers are responsible for filing and paying their own taxes.
- Refunds or adjustments are handled case-by-case via billing@irhyde.com.
5. Safety and conduct
Zero tolerance applies to harassment, discrimination, weapons, intoxication, fraud, or tampering with vehicles and software. We may disable accounts immediately, notify regulators, or provide information to law enforcement when required.
6. Data protection
Our Privacy Notice and Data Processing Addendum describe how we collect, process, store, and transfer personal data. By using the services you consent to those practices, including cross-border transfers as permitted by law.
7. Intellectual property
All trademarks, code, content, analytics, and documentation remain the property of iRhyde Mobility or its licensors. Feedback may be used without obligation.
8. Disclaimers and limitation of liability
The services are provided “as is”. To the maximum extent permitted by law, iRhyde disclaims all warranties. iRhyde is not liable for indirect, incidental, punitive, or consequential damages. In no event will our aggregate liability exceed the fees paid to us in the prior six months.
9. Termination
We may suspend or terminate access if you breach this Agreement or where required by law or safety considerations. You may close your account at any time; certain obligations (payments, confidentiality, IP ownership) survive termination.
10. Insurance, vehicle standards & background checks
- Drivers must maintain compulsory third-party and comprehensive insurance meeting local minimums. Proof may be requested at any time.
- Vehicles must pass annual inspections, include safety equipment (seat belts for all passengers, fire extinguisher where required), and remain free of branding that violates national advertising laws.
- We may deploy telematics or photo audits to validate compliance.
- Drivers and courier partners may undergo background and criminal record checks as permitted by law. Failing to provide consent or accurate information may lead to suspension.
11. Governing law and dispute resolution
Unless a local law mandates otherwise, this Agreement is governed by the laws of the State of Delaware, USA. Parties agree to first attempt good-faith negotiations, then binding arbitration under internationally recognised rules. Class actions are waived where permitted. Consumers in the EU/UK may rely on mandatory local protections and may bring disputes before their competent courts.
12. Notices & contact
Legal notices must be sent to legal@irhyde.com. We may provide notices via email, push notifications, SMS, or other contact details saved in your profile. Regional subsidiaries may also contact you directly when required by local law.
11. Changes
We may update these Terms to reflect regulatory changes or new features. Updated versions are posted on this page with the “Last updated” date. Continued use after changes constitutes acceptance.
